If I had durable power of attorney as well as Last Will & Testament rights for my mother (who has been diagnosed with vascular dementia) can other family members sue me for financial exploitation? Every dime that was spent was specifically for her and in her name. Plus I have been on her primary bank accounts for 19yrs. Also said family members stole her from assisted living and have recently kept her at an undisclosed location. My mother has been a functioning alcoholic, narcissist with by-polar all my life. They also got her to sign paperwork to revoke the durable POA. HELP.

If you had POA you had to keep meticulous records as a part of that financial fiduciary duty and you had to do this under the law if you had taken on financial management for an incompetent senior. Yes, your family can ask that those records be examined in court if they contest a will. Their standing in asking a judge (via their own attorney) to examine POA records would be BETTER if the person were alive. Once the person is gone it is late in the game to discuss financial management.

You say you had "last will and testament rights". What do you mean by that statement? Are you simply one of the beneficiaries or are you also the executor. If you are the executor and the family already doesn't trust you they will be getting their own attorneys to follow how you manage gathering the estate, again keeping meticulous records, and how you distribute the estate.

Anyone can hire an attorney to investigate anything. Then it is up to the courts how it all goes.
